The Site does not currently require users to create an account or register to access general content or submit an inquiry. Users who submit the inquiry form or consultation booking form do so as guests.
Any personal information submitted through the Site's inquiry form, consultation scheduling tool, or newsletter signup is governed by our Privacy Policy, which is incorporated into these Terms by reference.
If account functionality is introduced in the future, these Terms will be updated accordingly, and users will be notified of any changes that affect their rights or obligations.
You agree to provide accurate, current, and complete information in any form submission made through the Site. You agree not to submit false, misleading, or fraudulent information in connection with any inquiry, booking, or communication with the Company.
4. Content Ownership and Intellectual Property
All Content published on the Site, including but not limited to event photography, design concepts, written copy, graphics, logos, the Elite Luxz Events name and wordmark, the wings emblem, and all brand assets, is the exclusive intellectual property of Elite Luxz Events L.L.C. or its licensed content providers.
All Content is protected under applicable United States copyright, trademark, and intellectual property laws. No Content may be reproduced, distributed, modified, publicly displayed, published, or used in any commercial or non-commercial capacity without the prior written consent of Elite Luxz Events L.L.C.
Unauthorized use of the Company's intellectual property, including downloading, screenshotting, reposting, or reproducing event imagery or brand assets without permission, constitutes infringement and may result in legal action.
The Elite Luxz Events name, logo, tagline ("Captivating Moments. Lasting Legacies."), and all associated brand identifiers are trademarks of Elite Luxz Events L.L.C. Nothing in these Terms grants any User a license to use Company trademarks for any purpose.
If you believe Content on the Site infringes upon your intellectual property rights, please contact us at info@eliteluxzevents.com with a detailed description of the alleged infringement.
5. User-Generated Content
By submitting any content to the Company through the Site, a review platform, social media, or any other channel associated with Elite Luxz Events, including testimonials, reviews, photographs, or written feedback, you grant Elite Luxz Events L.L.C. a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, display, distribute, and adapt such content for marketing, promotional, and business purposes, including but not limited to the Site, social media, and print materials.
You represent and warrant that:
You own or have the necessary rights to submit the content. The content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. The content is accurate and not misleading.
The Company reserves the right to review, moderate, edit, or decline to publish any User-Generated Content at its sole discretion, without notice or obligation to the submitting party.
The Company will not publish identifiable photographs, names, or location details from private events without the explicit written consent of the client associated with that event.
6. Prohibited Activities
By accessing or using the Site, you agree not to engage in any of the following activities:
Misuse of the Site. Using the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
Fraudulent Submissions. Submitting false, misleading, or fraudulent inquiries, booking requests, or contact form entries.
Intellectual Property Infringement. Reproducing, downloading, distributing, or using any Content from the Site without prior written authorization from Elite Luxz Events L.L.C.
Harmful or Disruptive Conduct. Attempting to gain unauthorized access to any part of the Site, its servers, or any associated systems. Introducing viruses, malicious code, or any technology designed to disrupt or damage the Site or its users.
Spam and Unsolicited Communications. Using any information obtained through the Site to send unsolicited communications or spam to the Company, its team, or any associated individuals.

The Site may contain links to or integrations with third-party websites, platforms, and services, including but not limited to:
Calendly, for consultation scheduling. Zazzle, for merchandise fulfillment and purchase. Google Business Profile, for reviews and business information. Instagram and other social media platforms.
These Third-Party Services are operated independently of Elite Luxz Events L.L.C. The Company does not control, endorse, or assume responsibility for the content, privacy practices, terms of service, or conduct of any third-party platform.
Your use of any Third-Party Service is governed by that platform's own terms and conditions and privacy policy. Elite Luxz Events L.L.C. is not liable for any loss, damage, or dispute arising from your use of a Third-Party Service accessed through or in connection with the Site.
The inclusion of any third-party link or integration on the Site does not constitute an endorsement of that platform or its operators.
8. Limitation of Liability and Disclaimers
"As Is" Basis. The Site and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Company makes no representations or warranties regarding the accuracy, completeness, reliability, or availability of the Site or its Content.
No Guarantee of Results. Nothing on the Site constitutes a guarantee of any specific outcome, result, or level of service. Event services are governed by separate written service agreements entered into between the Company and the client.
Limitation of Liability. To the fullest extent permitted by applicable law, Elite Luxz Events L.L.C., its founder, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if the Company has been advised of the possibility of such damages.
Maximum Liability. In no event shall the Company's total liability to any User for any claim arising from or related to the Site exceed the amount paid by that User to the Company in the twelve months preceding the claim, or one hundred dollars ($100.00), whichever is greater.
Jurisdictional Limitations. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, the Company's liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Elite Luxz Events L.L.C., its founder, officers, employees, contractors, agents, licensors, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
Your access to or use of the Site. Your violation of these Terms. Your submission of any false, infringing, or harmful content through the Site. Your violation of any third party's rights, including intellectual property rights or privacy rights. Any misrepresentation made by you in connection with your use of the Site or engagement with the Company.
This indemnification obligation survives the termination of these Terms and your use of the Site.
10. Termination
The Company reserves the right, at its sole discretion and without prior notice, to:
Suspend or terminate your access to the Site for any violation of these Terms. Remove any User-Generated Content that violates these Terms or any applicable law. Discontinue, modify, or restrict any feature or portion of the Site at any time.
Upon termination of your access, all rights granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination, including Sections 4, 8, 9, and 11, will continue in full force and effect.
The Company is not liable to you or any third party for any termination of your access to the Site.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
By using the Site, you irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in San Diego County, California.
12. Changes to Terms and Conditions
Elite Luxz Events L.L.C. reserves the right to update, modify, or replace these Terms at any time at its sole discretion. When material changes are made, the "Last Updated" date at the top of this page will be revised accordingly.
